Priority date cut-offs in the third employment-based immigrant category will advance slightly for most countries in October.

The Department of State has released the October Visa Bulletin, its projection of immigrant visa availability for the first month of Fiscal Year 2011. In October, priority date cut-offs for most employment-based preference categories will continue to advance, though only by a few weeks for most countries. In addition, the employment-based third preference (EB-3) category will once again become available for Mexico, though with some retrogression, after having been unavailable since April of this year.

In the employment-based second-preference (EB-2) category, priority dates will advance by two weeks for China, to May 22, 2006, but will be unchanged for India, remaining at May 8, 2006. The EB-2 category will remain current for all other countries. In the employment-based third preference (EB-3) subcategory for professionals and skilled workers, cut-off dates will advance by two weeks for India (to January 15, 2002) and China (to November 8, 2003) and by three weeks for most other countries, to January 8, 2005. For Mexico, the EB-3 professional and skilled worker subcategory will resume availability with a cut-off date of April 22, 2001, a retrogression of just over one year from the last time the subcategory was available for that country. In the EB-3 other worker subcategory, priority dates will remain unchanged for most countries, but will advance by two weeks for India. The other worker category will resume availability for Mexico with a cut-off date of April 22, 2001, a retrogression of just over one month from the last time that the subcategory was available for that country. All other employment-based categories remain current.

In October 2010, priority date cut-offs for employment-based immigrant categories will be as follows:

EB-1

Current for all countries.

EB-2

China – May 22, 2006.
India – May 8, 2006.
All other countries – current.

EB-3 Professionals and Skilled Workers

China – November 8, 2003.
India – January 15, 2002.
Mexico – April 22, 2001.
All other countries – January 8, 2005.

EB-3 Other Workers

India – January 15, 2002.
Mexico – April 22, 2001.
All other countries – March 22, 2003.
